## CBDT Guidelines

1. No TCS on expenditure through International Credit Card while being overseas

2. Threshold of ₹10 lakhs is a combined threshold for TCS on LRS (Education + Medical + Other Purpose → combined limit ₹10 lakhs)

3. Threshold of ₹10 lakhs for LRS is counted remitter-wise, NOT authorised dealer-wise

4. TCS u/s 206C(1G) is NOT applicable to a Non-Resident who has visited India during the P.Y.

## Definitions

### Education Purpose Includes:

  • Travelling fees
  • Tuition fees
  • Day-to-day expenses

### Medical Purpose Includes:

  • Travelling expenses (patient + attendant)
  • Treatment expenses
  • Day-to-day expenses

### Overseas Tour Program Package

Package should include at least TWO of the following:

1. International travel ticket

2. Hotel accommodation (with or without food)/boarding/lodging

3. Any other expenditure of similar nature or in relation thereto

Worked example

### Example 1

Example: Mr. A remits ₹15 lakhs for his son's education abroad (own funds, not loan). What is TCS?

Answer: Education purpose, above ₹10 lakhs. TCS = 5% on excess = 5% × ₹5,00,000 = ₹25,000.

### Example 2

Example: Mr. B purchases an overseas tour package for ₹8 lakhs. What is TCS?

Answer: Overseas tour package up to ₹10 lakhs is 5%. TCS = 5% × ₹8,00,000 = ₹40,000. (Note: For tour packages, 5% applies from the first rupee, not just above ₹10 lakhs.)

### Example 3

Example: Mr. C remits ₹12 lakhs for education using loan from financial institution. What is TCS?

Answer: Up to ₹7 lakhs: 0%. Above ₹7 lakhs: 0.5% on ₹5,00,000 = ₹2,500. Concessional rate due to education loan.

⚠️ Common exam mistakes

  • Treating overseas tour package threshold like other categories — TCS @ 5% applies from ₹0 to ₹10L for tour package
  • Aggregating threshold across multiple authorised dealers — it is remitter-wise but combined across purposes
  • Forgetting non-resident exemption when person visited India during PY
  • Applying TCS on international credit card spending while overseas — exempt per guidelines
