Definition of 'Enactment' [Section 3(19)]

# Definition of 'Enactment' — Section 3(19)

## Statutory Definition

> Section 3(19): 'Enactment' shall include a Regulation or any Act (or a provision contained therein) made by the Union Parliament or the State Legislature.

## Three Levels of Meaning

The definition is inclusive and embraces three concepts:

### 1. A Regulation

Delegated legislation made under statutory authority.

### 2. An Act

Legislation passed by:

  • The Union Parliament, OR
  • A State Legislature

### 3. A Provision within an Act

Not just the whole Act, but even a single provision/section within an Act qualifies as an 'enactment'.

## Why This Definition Matters

'Enactment' is broader than 'Act':

  • 'Act' = the whole law
  • 'Enactment' = the whole law OR any part of it OR a regulation

This is important when interpreting clauses like "any enactment for the time being in force" — it covers Central Acts, State Acts, and even subordinate legislation/regulations.

## Examples

ItemIs it an Enactment?
Companies Act, 2013Yes — entire Central Act
Section 149 of Companies ActYes — a provision within an Act
Maharashtra Stamp ActYes — State Legislature Act
Companies (Audit and Auditors) Rules, 2014Yes — Regulation
Notification under a sectionYes — derives from regulation

## Distinction from 'Act'

'Act''Enactment'
Refers to whole statuteRefers to a Regulation, Act, or even a provision
Narrower termBroader term
Generally Central Act when definedIncludes Central AND State legislations

## Practical Use

Whenever a statute says "any enactment", it gives the widest possible scope — capturing:

  • Central legislation
  • State legislation
  • Subordinate legislation
  • Any part of any of the above

Worked example

### Example 1

Q: Is a single section of an Act considered an 'enactment' under Section 3(19)?

A: Yes. Section 3(19) defines 'enactment' to include a Regulation or any Act 'or a provision contained therein'. A single provision/section of an Act therefore qualifies as an enactment.

### Example 2

Q: Does the term 'enactment' include State legislations?

A: Yes. The definition expressly includes any Act made by the Union Parliament OR the State Legislature. So both Central Acts and State Acts (and even regulations) are enactments.

⚠️ Common exam mistakes

  • Restricting 'enactment' to only Acts of Parliament — it includes State Acts and regulations too
  • Confusing 'enactment' with 'Act' — enactment is broader
  • Not realizing that a single provision can be called an enactment
