## Amendment of Registration [Section 28]

Registration details, once granted, may need updates. The law classifies updateable information into Core Fields and Non-Core Fields.

### Categories of Amendment

Non-Core FieldsCore Fields
• Email ID• Legal name of business
• Mobile Number• Address of principal or additional place of business
• Day-to-day functionaries• Addition/deletion of main Partner, Karta, Managing Director, Board of Directors, etc.

### Procedure for Amendment

Step 1: Submit application within 15 days from the date of change.

Step 2: Different treatment based on field type:

(a) Core Areas:

  • Application goes to GST common portal → P.O. processes
  • P.O. may permit amendment within 15 days from application
  • If permitted → amended registration certificate is granted

(b) Non-Core Areas:

  • Amendment made automatically on the GST portal (no P.O. approval required)

### Important Restriction

Change in PAN or State → Registration CANNOT be amended.

  • Existing registration must be cancelled, AND
  • A new registration must be obtained.

Reason: GSTIN is derived from PAN and State Code; any change in these fundamentally changes the GSTIN itself.

Worked example

### Example 1

Example 1: M/s ABC Co. shifts its principal place of business from Delhi to Mumbai. How should they handle this change?

Answer: This is a change in State. Registration cannot be amended. ABC Co. must cancel its Delhi registration and apply for a fresh registration in Maharashtra.

### Example 2

Example 2: A proprietorship converts into a private limited company. Can the existing registration be amended?

Answer: No. Conversion involves a change in PAN (proprietor's PAN to company's PAN). Existing registration must be cancelled and fresh registration obtained.

### Example 3

Example 3: M/s XYZ wants to change its email ID and add a new director. Which is core and which is non-core?

Answer: Email ID change = Non-core (automatic update). Addition of new director = Core (requires P.O. approval within 15 days).

⚠️ Common exam mistakes

  • Thinking change in business address within the same State requires fresh registration — only address change across States requires it.
  • Forgetting the 15-day window to apply for amendment from the date of change.
  • Treating change of mobile number/email as a core field requiring P.O. approval — these are non-core and updated automatically.
  • Forgetting that PAN change = new registration (e.g., when proprietor becomes partner in a firm).
