## Definition Section as an Internal Aid

The definition section of a statute typically gives precise meanings to terms, ensuring accuracy and certainty. But sometimes the definition section itself can be ambiguous.

### Key Rule

  • An ambiguous definition must not be read in isolation.
  • It must be read in the context of the phrase it defines.
  • The function of a definition is to give accuracy and certainty — never to contradict the meaning of the phrase.
  • Therefore, an ambiguous definition is interpreted in the light of the other provisions of the Act.

### Why This Matters

A definition is meant to remove vagueness. If reading it literally makes the operative section unworkable or contradictory, the courts read the definition in harmony with the rest of the statute, not against it.

Worked example

### Example 1

Industrial Disputes Act, 1947 — meaning of 'Retrenchment':

  • Termination of a seasonal worker after the seasonal work is over → NOT retrenchment (because the worker knew the engagement was seasonal).
  • Termination of a daily wager engaged on a project, when the project ends → AMOUNTS to retrenchment IF the worker was not told at the time of employment that the engagement would end on project completion.

The difference turns on the worker's knowledge of the temporary nature at the time of engagement — a contextual reading of the definition rather than a literal one.

  • Treating the definition section as a closed silo and reading it in isolation from the operative provisions.
  • Assuming the definition will always be clear merely because it is in a 'definitions' section.
  • Using the definition to override or contradict the section it defines, instead of harmonising the two.
