# Interpretation vs Construction
Though often used interchangeably, the two terms have distinct conceptual roles.
## Definitions
### Interpretation
The activity of identifying the meaning of a particular use of language in context.
- Concerned with: What do the words mean?
- Used when: The language is plain but its meaning needs to be ascertained.
### Construction
The activity of applying that meaning to particular factual circumstances.
- Concerned with: What does the law dictate in this situation?
- Used when: The meaning is not plain OR the situation lies beyond the direct expression of the text.
## Key Distinction
| Aspect | Interpretation | Construction |
|---|---|---|
| Question Answered | What do the words mean? | How does the law apply? |
| When Used | Words are plain | Words are unclear or facts uncovered |
| Court's Role | Sticks to plain meaning of language | Draws conclusions beyond direct expression |
| Scope | Linguistic | Operational / applicational |
| Result | A meaning | A legal conclusion / application |
## Core Rule (Examiner-friendly)
> Where the Court sticks to the plain meaning of the language used by the legislature, it is INTERPRETATION.
>
> Where the meaning is NOT plain, and the Court must decide whether the wording covers the situation before it, the Court is doing CONSTRUCTION.
## Practical Reality
The two terms are often used interchangeably in courts, textbooks and statutes. The distinction is more academic than rigid in Indian practice.
## Memory Hook
- Interpretation = Identify meaning of words.
- Construction = Conclude how to apply law to facts.
